Ohrid Techathlon’s Rules and Conditions

General Code of Conduct

Ohrid Techathlon is a community event intended for creation, innovation, collaboration and learning in the Ohrid’s startup/innovation eco-system and student community. We value the participation of each member of the community and want all participants to have an enjoyable experience. Accordingly, all participants are expected to show respect and courtesy to other participants throughout the event. To make clear what is expected, all participants of this event are required to conform to the following General Code of Conduct (for more specific details visit here). Organizers will enforce this general code and rules throughout the event.

The spirit of The Code is to prohibit activities including but not limited to:

• Comments that others find offensive
• Cheating or taking unfair advantage of other participants’ work or efforts
• Any activity related to harassing, demeaning, mocking, or intimidating others, especially this behavior as it relates to characteristics such as:
• Gender
• Sexual orientation
• Physical or mental ability
• Age
• Socioeconomic status
• Ethnicity
• Physical appearance
• Race
• Religion
• Country of origin

Examples of other prohibited behaviors include, but are not limited to:

• Stalking
• Unwanted sexual attention
• Use of sexualized content

Participants asked to stop any behavior deemed as harassment are expected to comply immediately. If a participant fails to comply they will be asked to leave the event. Sponsors, judges, mentors, volunteers, organizers, Ohrid Techathlon team, and anyone else at the event are also subject to the Code.

If a participant engages in behavior that violates the Code, the event organizers will take any action they deem appropriate, including warning the offender or expelling them from the event.

If you feel uncomfortable or think there may be a potential violation of the code of conduct, please report it immediately to one of the event organizers or by emailing us at contact@ohridtechcity.com. All reporters have the right to remain anonymous.

We expect participants to follow these Code of Conduct terms at all OTC/Startup Ohrid/Ohrid Techathlon events, workshop venues, hackathon-related competitions, meet-ups and social events (in both on-line and off-line versions)!

Event Rules & Conditions

1. The following rules & conditions (the “Rules”) apply to this Ohrid Techathlon (the “Event”). By clicking the “I Accept” button, you acknowledge that you have read these Rules, understand them, and agree to be bound as follows:

2. If you are under the age of 18, you must obtain consent from your parent or guardian to participate in our events and your parent or guardian is required to agree to these conditions – an agreement signed by your parent or guardian must be submitted separately before attending The Event. You acknowledge that, even as a minor, you must read and understand the content of this Agreement, and that you have the capacity and intend to be bound by the terms of this Agreement.

3. You must comply with all facility and equipment rules and requirements during your participation in The Event, including all safety instructions and requirements. You are not to take unreasonable risks while using the facilities where The Event is located, including causing any other person using such facilities an unreasonable risk of harm.

4. You assume full responsibility for any damage or injury caused by you in your participation in the Event (whether to persons or property, and whether to yourself or others) and release OHRID TECH CITY – Association for technological development and support of startups and high-tech companies – Ohrid (and its affiliates) (hereinafter, known collectively as either “OHRID TECH CITY”, “OTC”, “Organizer”, “we”, “our” or “us”), the Event, the (co)organizers of the Event (the “Organizers”, the “Co-organizer”), all (corporate or institutional) partners of the Event (“Partners”), all sponsors of the Event (“Sponsors”), the Event volunteers, the Event staff, guests of The Event and all other participants in The Event  (collectively, the “Releasees”) from any liability therefore. YOU ARE AWARE THAT YOUR PARTICIPATION IN THE EVENT IS SOLELY AT YOUR OWN RISK, AND THAT THE RELEASE HEREIN IS INTENDED TO REFLECT THAT UNDERSTANDING

5. You (and your team) will own any developments that you create during the Event, and all right, title and interest in those developments, including the intellectual property rights therein, shall belong to you. However, you acknowledge that during the course of the Event, you may obtain access to products, developments, information and other materials belonging to Ohrid Tech City, other participants of the Event, the Event Partners, the Sponsors and/or other third parties (“Third Party Materials”), and that nothing in this Agreement is deemed to transfer any ownership, right, title or interest in such Third Party Materials to you. Your only rights to the Third Party Materials shall be those expressly granted to you by the owner(s) of the Third Party Materials. Specifically, any APIs or other software provided to you by the Sponsors/Event Partners are subject to the subscription terms and software licenses associated with such APIs or other software.

6. By entering this Event, you represent and warrant that your participation complies with these Rules and that you have sufficient rights to (1) authorize the publication, dissemination and or evaluation of any submission materials, presentations, hacks, project proposals, prototypes, developed solutions, project work, pitch decks and/or final competition submission(s) (“Submitted Materials”); (2) allow the Organizers, Sponsors and Partners to use and to authorize others to use, publish, disseminate and/or evaluate your Submitted Materials. Further, you are entirely responsible for your Submitted Materials, in whole or in part, if: (a) determined to be defamatory, offensive or otherwise inappropriate; (b) determined to violate any laws, rules or regulations; (c) determined to be infringing, or constitute a misappropriation of any intellectual property rights or confidential or proprietary information of any third party; or (d) determined to violate these Rules. Your Submitted Materials must be true and accurate and in compliance with these Rules in all regards. At any time, the Organizers at their sole discretion, reserve the right to remove your Submitted Materials from the Event, in whole or in part, for any violation of these Official Rules.

7. You acknowledge that the Event is intended to be a place where ideas are shared freely, and therefore acknowledge that any information that you share with other participants of the Event, the Sponsors and/or other third parties during the Event is solely at your discretion and risk. If you wish to protect your information, it is solely your responsibility to implement confidentiality and security measures with respect to the persons to whom you are disclosing your information. None of the Releasees shall have any responsibility under this Agreement or by virtue of their participation in the Event with respect to your information.

8. You are not be a citizen or resident of any jurisdiction subject to international sanctions as enforced by the UNSC – United Nations Security council, EU Council or USA Office of Foreign Assets Control, including without limitation Burma, Crimea and Sevastopol, Cote d’Ivoire, Cuba, Democratic Republic of Congo, Iran, Iraq, Libya, North Korea, Sudan, Syria, Zimbabwe and other countries that are under international sanctions or in which military or political conflicts or war situations still exist. Also you must not be named by OFAC as a Specially Designated National or Blocked Person.

9. You acknowledge that the Organizers, Co-organizers and Ohrid Tech City have the right to reject participants in the Event at their sole discretion.

10. You acknowledge that the organizers and partners of The Event, including OTC/Ohrid Techathlon [Add other Co-organizer] (collectively, the “Organizers” or “Co-organizers”) will be recording The Event event on video, photographs, audio recording and other media, and therefore agree that:

1) The Organizers have the unrestricted right to use your likeness, image, voice, opinions, and appearance, and also any images of your projects, developments, materials and belongings made at or brought to the Event, captured through video, photographs or other media during the Event for the express purpose of creating promotional material (the “Images”), for the purposes of use in websites, promotional materials, publications and other media of any of the (Co)Organizers, whether in print or electronically (the “Materials”). The foregoing right includes permission to copyright, use, re-use, publish, and republish Images in which you may be included, intact or in part, composite or distorted in character or form, without restriction as to changes or transformations, in conjunction with your own or a fictitious name, reproduction in color or otherwise, made through any and all media now or hereafter known;

2) The (Co)Organizers shall solely own the Materials in which you or your Images, in whole or in part, may appear, including copyright interests, and you have no ownership rights therein;

3) You give all clearances, copyright and otherwise, for use of your Images, and waive any moral rights that you may have in the Materials in which you or your Images may appear. The rights granted to the (Co)Organizers herein are perpetual and worldwide. For greater certainty, you agree that your images may continue to be used after the completion of the Event;

4) You relinquish any right that you may have to examine or approve the Materials in which you or your Images may appear or the use to which they may be applied; and

5) You hereby release, discharge and agree to save harmless each and all of the (Co)Organizers from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form of the Images whether intentional or otherwise, that may occur or be produced in the recording of the Images or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.

10. You agree that the (Co)Organizers may share your registration details, Facebook/Instagram /TikTok/LinkedIn/Github profiles, details of your Event submission, and other information obtained from you in the course of, or relating to, the Event with the Sponsors or Event Partners, and acknowledge that such Sponsors or Event Partners may contact you during and after the Event. By agreeing to this document and/or participating in the Event, you are providing your express consent to communications by the (Co)Organizersm Sponsors and Event Partners (including email communications, both marketing and informational) respecting the products and services of the Organizers, Sponsors and Event Partners, and future events.

11. For valuable consideration, including permission to take part in the Event, the undersigned on behalf of him/herself, his or her personal representatives, assigns, heirs and next of kin: hereby covenant not to sue, and release, waive, and discharge the Releasees, their owners, officers, agents, affiliates, employees, volunteers, and/or any other person or entity in any way associated with the Event, from liability for any injury to your person or property or death arising out of or related to your participation in the Event, whether caused by an act of negligence of the Releasees or otherwise; and hereby assume full responsibility for any risk of bodily injury, death or property damage arising out of or related to your participation in the Event, whether occurring to you or to any other person or entity for whom you are responsible or with whom you are associated, and whether caused by an act of negligence of the Releasees or otherwise. The foregoing release includes, but is not limited to, any occurrences of personal injury, illness (food-borne or otherwise), and loss of belongings, whether by theft or otherwise. You further agree that this instrument (the terms of which collectively are referred to as the Rules) is intended to be as broad and inclusive as is permitted by the laws of the Republic of North Macedonia and that if any portion thereof is held invalid, that portion shall be invalid only to the extent required by law, and the balance shall, notwithstanding, continue in full force and effect.

12. You agree to indemnify and hold the (Co)Organizers, Sponsors and Event Partners (and judges, mentors, volunteers, organizers, OTC team administering the Event) and each of their employees, representatives, agents, attorneys, affiliates, directors, employees, officers, managers, and shareholders (the “Indemnified Parties”) harmless from any damage, loss, cost, or expense (including without limitation, attorneys’ fees and costs) incurred in connection with any third-party claim, demand, or action (“Claim”) brought or asserted against any of the Indemnified Parties, alleging facts or circumstances that would constitute a breach of any provision of these Rules by you; arising from, related to, or connected with your entry, Submitted Materials, presentations and participation in any way in any aspect of Event, including receipt of any prize. If you are obligated to provide indemnification pursuant to this provision, the Indemnified Parties may, in their sole discretion, control the disposition of any claim at your sole cost and expense. Without limitation of the foregoing, you may not settle, compromise, or in any other manner dispose of any claim without the (Co)Organizers’s express written consent.

13. If selected as a winner of a Ohrid Techathlon challenges, competitions or award(s), your acceptance of the OTC/Ohrid Techathlon/Sponsors/Event Partners’ award means you agree to the following:

1) You will not disparage OTC/Ohrid Techathlon or its products, services, agents, representatives, directors, officers, shareholders, attorneys, employees, vendors, business partners, affiliates, successors or assigns, or any person acting by, through, under or in concert with any of them, with any written or oral statement. Nothing in this paragraph shall prohibit the winner from providing truthful information in response to a valid subpoena or other legal process; however, the winning participant agrees to provide Organizer sufficient notice of such to allow Organizer the opportunity to oppose such subpoena or legal process prior to providing any information (unless expressly prohibited by applicable law).

2) You agree that awards are subject to availability and OTC/Ohrid Techathlon, the Sponsors and Event Partners reserve the right to substitute or withdraw any prize without giving notice at their sole discretion.

3) Any media, such as a blog post, that is created about winning the Event, will first be shared with the OTC/Ohrid Techathlon and (co)Organizers’ team beforehand so that we can coordinate and help you spread the message.

4) You agree to an interview with a writer affiliated with the OTC/Ohrid Techathlon and (co)Organizers’ team, which will result in featuring your project on the OTC/Ohrid Techathlon website(s) and sharing your project with the greater community.

14. Damage and Disruptions: You agree that the all participants (Mentors, Judges, Invitees Organizers etc) of the hackathon, including yourself will be required to ensure that their (yours) actions will not disturb individuals outside the venue or lead to public disturbances, property damage, or destruction. In instances of such behavior, those responsible will be held accountable and required to provide compensation and requested to leave the Event and the premises immediately.

15. Original Work: Your participation in the Event must only concern your own (your team’s) original work and must not, so far as you are aware, infringe the intellectual property or any other legal or moral rights of any third party, and must not violate applicable law or refer to or portray OTC/Ohrid Techathlon in a disparaging or negative manner. Participants may flag up and define pre-existing IPR if they wish. It is recommended that such pre-existing IPR be identified in a written document before disclosure at the Event.

16. Independence and Similar Ideas: You acknowledge and agree that a third party may produce similar ideas or concepts during the Event. You also acknowledge and agree that the OTC, its partners or sponsors with their mandate in the innovation and R\&D area, may be working on similar ideas independently whether now or in the future. You agree not to make any claims or demands of any nature against the Organizer(s), Co-organizers, OTC, its partners or sponsors in relation to your participation in or contribution to the Event.

17. Winner selection: A panel of Ohrid Techathlon (or Ohrid Techathlon/OTC appointed external) judges will select one or several winning ideas for most sustainable solution with best possibility for realization and any other categories as determined by Ohrid Techathlon/OTC. The winning idea will be announced at/during the event. The winning idea will also be published on the OTC/Ohrid Techathlon’s (and other related) websites. The decisions of OTC/Ohrid Techathlon and the judges are final and binding and may not be appealed.

18. Prize: Ohrid Techathlon/OTC will announce the type of prizes before the Event. Ohrid Techathlon/OTC reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Each winner is responsible for the payment of taxes on the prize and for any other costs and expenses associated with the acceptance and use of a prize not specifically described above.

19. Media Policy: The following terms and conditions apply to any individual that is attending our in-person events.

Photography, Audio & Video Recording

By attending the Ohrid Techathlon you acknowledge and agree that the event (or any part of it) may be photographed or recorded by us or our partners. You agree to permit us, or any third party licensed by us, to use, distribute, broadcast, or otherwise globally disseminate your likeness, name, voice and words in perpetuity in television, radio, film, newspapers, magazines and other media now available and hereafter developed, both before, during and any time after the Conference/Event, and in any form, without any further approval from you or any payment to you. This grant includes, but is not limited to, the right to edit the media, the right to use the media (alone or together with other information), and the right to allow others to use or distribute the media.

OTC/Ohrid Techathlon takes the privacy of its attendees seriously and as such we are taking certain measures in an attempt to maintain the individual privacy needs of our attendees. If you would like to opt-out, to be captured within any form of Media, we will ask you to sign an opt-out form on-site at the event and we will ensure that OTC/Ohrid Techathlon and our partners respectfully is aware.

Additionally, OTC/Ohrid Techathlon cannot take any responsibility for photographs, video and audio recordings taken by other attendees of the event. If you have any questions regarding this policy, please feel free to reach out to us at contact@ohridtechcity.com

20. You agree to be bound to enforce and comply with OTC/Ohrid Techathlon General Code of Conduct principles listed below:

• Treat everyone involved (participants, hackers, mentors, jury, organisers, sponsors, partners) with utmost respect and kindness.
• Embrace diversity and be considerate of different backgrounds, perspectives and experiences.
• Harassment, discrimination or any form of inappropriate behaviour will not be tolerated. This includes racist, sexist, or exclusionary jokes.
• The consumption of alcohol, narcotic or psychotropic substances is strictly prohibited during the event.
• Respect the intellectual property rights of others and ensure that the work submitted is original.
• Immediately report any behaviour that compromises the safety or well-being of participants to the organisers. All reports will be handled confidentially and taken seriously.
• Be considerate in speech and actions, and actively seek to acknowledge and respect the boundaries of fellow attendees (participants, mentors, judges, speakers, partners, sponsors, investors, exhibitors, media, and any other 3rd parties – individuals, representatives, companies, institutions interacting with the Event)
• Refrain from demeaning, discriminatory, or harassing behavior and speech.
• Be authentic and empathetic. Treat every participant with kindness and respect. We encourage open-mindedness and active listening.
• Be mindful and collaborative. Focus on building solutions together. Your ideas are valuable, but so are everyone else’s.
• Be professional and considerate. Avoid any form of disruptive or inappropriate behavior that could distract from the creative energy of the event.

21. Scope: We expect you and all conference participants (sponsors, volunteers, speakers, attendees, and other guests) to abide by this Event rules and conditions at all conference venues and conference-related social events. Failure to adhere to this Rules may result in immediate removal from the event and future exclusion from Ohrid Techathlon activities.

22. Governing law and dispute resolutions:This Rules and Conditions and all attendant protection obligations shall be construed and interpreted under the substantive law of the Republic of North Macedonia. Jurisdiction for any dispute shall be vested exclusively in the competent courts of Ohrid.

23. Duration: The present Rules and Conditions shall have an indefinite duration (meaning before, during and after the Event ) as well as the User’s Registration, unless terminated by the Organizer or User in accordance with the procedures set forth in the present Rules and Conditions, Code of Conduct, Privacy Policy and Terms of Use and, if applicable, in the particular conditions.

24. Modification and supremacy clause: We may update or modify the OTC/Startup Ohrid/Ohrid Techathlon’s Rules and Conditions periodically to reflect changes in our practices or for other operational, legal, or regulatory reasons. We reserve the right to do so at any time and at our sole discreation. Any changes will be effective immediately upon posting on this page.We may notify You of any changes by posting the new Rules and Conditions on this page and by updating its status to “Last updated” date at the top of this Rules and Conditions page/document.

OTC has no mandatory obligation to directly notify You of any changes to these Rules and Conditions so You are strongly advised to check the website regularly and review Rules and Conditions periodically. Changes to this Rules and Conditions are effective when they are posted on this page.
The most current version(s) will be posted at /rules-and-conditions/ . Continued use of OTC/Startup Ohrid/Organizer services shall constitute tacit acceptance of such modifications.

Miscellaneous

• Entire Rules and Conditions: These Rules and Conditions supersede all prior understandings.
• Severability: Invalid provisions do not affect remaining terms.
• Whole Rules and Conditions: Both Rules and Conditions (1. Rules and Conditions for Ohrid Tech City and 2. Rules and Conditions for Ohrid Techathlon (for event/s)) listed will be considered valid and as Rules and Conditions as a whole and will complement each other depending on the cases and conditions of application (use of the site(s), use of the services, digital and/or physical presence of the User, digital or personal (face to face) communication/interaction etc.)
• Online and Off-line Code of Conduct: Our Code of conduct applies both to our online and off-line activities and is valid for visitors/attendees/participants/registrants to our website(s), media channel(s), and/or events (co)owned, (co)organized or (co)managed by OTC, with regards to the all information that they are collected, managed or/and shared both on-line and off-line.
